Terms and Conditions of Sale

The purchase of any products offered on www.ornamentum.it website is subject to these General Terms and Conditions (“Terms and Conditions of Sale”). Individual consumers and corporations purchasing goods other than for resale may only place orders on the www.ornamentum.it website. Any resale or distribution of Ornamentum products purchased on www.ornamentum.it website is strictly prohibited. The products purchased on www.ornamentum.it are directly sold by Ornamentum of Claudia Lotierzo (“the Vendor”), with registered office at Via della Pace, 32 , 20025 Legnano – Milano– ITALIA, registered with the Companies Register of Milano (number REA MI- 2009613, P. Iva 02300330038). Requests for information should be made through our Customer Care.   1. Our commercial policy
    1.1

The Vendor offers the possibility of purchasing the products on www.ornamentum.it and develops the activity of e-commerce only towards the finals users that are considered “consumers”.

1.2
With the term “consumer”, we indicate a physical person that acts on www.ornamentum.it with aims that have nothing to do with a commercial, business or professional activity. If you are not a final consumer, please do not use our services to buy our products on www.ornamentum.it.


1.3

The Vendor will have the power to neglect the orders that come from subjects that are not considered final consumers or any other order that does not comply with commercial policy.


1.4
These General Terms and Conditions of Sale regulate only the offer, the sending and the reception of the orders of products on www.ornamentum.it between the users of www.ornamentum.it and the Vendor.


2. How to Execute a Contract with the Vendor

2.1
To place an order, you must follow the online purchasing procedure, compiling the electronic order form and transmitting it to the Vendor, following the instructions.

2.2
Before proceeding to the purchase of the products through the transmission of the order form, you will be asked to carefully read the General Terms and Conditions of Sale and the Return Policy, to print a copy using the print control and to store or reproduce a copy for your personal use. Moreover, we will provide you with a resume of the commercial and contract conditions that we establish for the purchasing of the products. Here you will find a link to the General Terms and Conditions of Sale and a resume of the information about the principle characteristics of each purchased product. These will include its price (including taxes), the payment methods that you may use to purchase the products, the delivery service, the return policy, the shipping costs and the geographical references of the e-mail of the Vendor and the date of delivery of the purchased goods. Furthermore, the Vendor will provide you with a resume of the conditions and ways to exercise your right of withdrawal and the ways and times of return of the purchased products (from the Cancellation form). You will also have information about the circumstances in which you will lose your right to cancel the order. If it is the case, you will be informed that, in case of cancellation, you will have to pay for the return of the products. In any case, we will remind you of the existence of the legal guarantee of compliance of the products, we will give you the references to contact our post-selling assistance service and we will remind you the possibility to use our independent and institutional conciliation service, RisolviOnline, provided by the Arbitral Chamber of the Chamber of Commerce of Milan.

2.3
In the order form, displayed immediately before the execution of the purchasing contract, we will give you a resume about the principle characteristics of each purchased product, its price (including taxes) and the shipping costs (including any extra cost for choosing a type of delivery which is different or faster than the standard one). The contract is executed when the Vendor receives your order form, after verifying that all the data of your order are correct.

2.4
The order form will be stored in our database for all the period of execution of the order and as long as it is established by the law. ou may access your order form by clicking on the section called My Order, in the Customer Care area.


2.5
When you proceed with the transmission of the order firm, you will be informed that the sending implies the obligation to pay the displayed price. Before proceeding to the transmission, you will be asked to check and correct any mistakes that may be present in the inserted data.

2.6
Italian is the language used for executing contracts with the Vendor.


2.7
After your order form has been submitted, the Vendor will process your order.


2.8
The Vendor reserves the right to withdraw any order in case of absence of sufficient guarantees of solvency or if they result incomplete or incorrect or in case of unavailability of the products. In the above cases, we shall inform you by e-mail that the contract has not been executed and that the Vendor has not carried out your purchase order specifying the reasons thereof. If the products presented on www.ornamentum.it are no longer available or for sale at the moment of you access to the website or when you place the order, the Vendor will take care to inform you as soon as possible, within thirty (30) days from the date of you order, about the unavailability of the ordered products. If you have placed the order and paid the price, the Vendor will provide for the refund, without any delay, of the amount you have paid and the contract would be considered solved between the parties.

2.9
Sending the order form, you unconditionally accept these General Terms and Conditions of Sale and you commit to respect them in your relation with the Vendor. If you do not agree with the terms of these General Terms and Conditions of Sale, please do not send the order form to purchase products on www.ornamentum.it.


2.10
By submitting an order form to and making a contract with the Vendor, you unconditionally accept and undertake to observe the provisions of these General Terms and Conditions of Sale. Should you not agree with certain provisions of these General Terms and Conditions of Sale, please do not submit your order form for the purchase of products on www.ornamentum.it.

3. Guarantees and Product Price Indication

3.1

On www.ornamentum.it, we only offer products marked with the Ornamentum trademark. These products are purchased by us directly from the fashion house and/or the manufacturer authorised by the fashion house.


3.2
The Vendor does not sell second-hand products, flawed products or products of lower quality than the corresponding market standards.


3.3
The main characteristics of products are shown on www.ornamentum.it on each product page. The products offered for sale on www.ornamentum.it may not exactly correspond to the real garments in terms of image and colours due to the Internet browser or monitor used.


3.4
Prices are subject to change and will be as quoted on our site from time to time, except in cases of obvious error. Check the final price of sale before sending the relevant order form.


3.5
All Products sold by www.ornamentum.it come with an identification tag attached with a disposable seal. When trying on the products you should not remove or alter the tag or seal from the purchased products should you wish to return the purchased product.


3.6
In case of return, the Vendor has the power to refuse the restitution or to refund just a part of the paid amount if the returned products do not have the identification tag, if they have been altered in their principle and quality characteristics, or if they have been damaged, as it is explained in chapter 7.10.

4.Payments
4.1
Payment of the product prices and relevant costs for shipping and delivery must be made by using one of the procedures indicated on the order form. You will not pay any extra cost that is superior to the ones beard by the Vendor, in relation to the mean of payment that you choose.

4.2
In case of payment by Credit/Debit Card, all details (for example, card number or expiration date) will be sent by encrypted protocol to Banca Sella or other banks which provide remote electronic payment services, without third parties having any access thereto whatsoever. Such details will not be used by the Vendor except for performing the procedure relevant to your purchase or issuing refunds in the case of returns in compliance with the exercise of your return right or for reporting cases of fraud to the police. The price for the purchase of products and the corresponding costs for shipping and delivery, as indicated in the order form, will be charged to your current account only when the purchased products are actually shipped.

  1. Consumer Rights and the Cooling-Off Period
    6.1
    If you are a Consumer, you may cancel your contract with the Vendor in relation to products purchased from www.ornamentum.it, without any penalty and without specifying the reason, by notifying the Vendor in writing within fourteen (14) calendar days, beginning on the day you receive the products. It is not possible to change the purchased product with another one.


6.2
To return the products you should notify us by completing and submitting the online Return Form* or by Contacting Us. If you decide to use the online Return form, transmitting it on www.ornamentum.it, the Vendor will send you a confirmation e-mail. If you choose another mean to send your return declaration, it is your responsibility to comply with the correct exercise of your consumer rights.


6.3

You can return the products to the Vendor by a courier within the fourteen (14) calendar days cooling-off period.

6.4
You will be responsible for the cost of returning the products to us, if the Vendor has not expressly exempt you from these costs in the moment of purchasing the products, or of you return the products by the same courier that is indicated in the Return form.

6.5

If you decide to use the approved courier (as indicated on the online Return form), you will not have to pay for the expedition of the purchased products that you want to return. The costs will be paid on your account directly by the Vendor, freeing you from any obligation of payment towards the courier. When paying you the restitution, the Vendor will withhold from the refund a lump sum that is equivalent to the costs of the standard shipping of the purchased products. Moreover, from the moment you give the purchased products to the courier indicated on the online Return Form, the Vendor exonerates you from any responsibility in case of loss or damage of the products during the shipping.

6.6
If you decide to use a different courier from the one indicated by the Vendor on the online Return Form, you would have to pay at your own account the shipping costs for the return of the purchased products. In this case, you will have the refund of an amount that corresponds to the standard costs of shipping of the purchased products, but there will be no refund for any extra cost you had by choosing a different type of shipping or faster than the standard one. The responsibility for any loss or damage of the products during the shipping may be on you, in case it is due to your neglecting choice of the courier and/or of the shipping mean.

6.7
To return the products:

  1. a) you should notify us in writing within fourteen (14) calendar days, beginning on the day you receive the products (or for purchases of multiple products, the day on which you received the last product) by completing and submitting the online Return Form* or by Contacting Us. You should keep a record of your cancellation notice;
  2. b) the products should not have been used, worn or washed;
  3. c) the identification tag should still be attached to the products with the disposable seal;
  4. d) the products should be returned in their original packaging;
  5. e) products should be returned to the Vendor within fourteen (14) calendar days of the date you notify us of your decision to cancel;
  6. f) the products should not have been damaged.


6.8
If your Return right is exercised following the indications and the terms of this section 6, the Vendor will provide for the refund of any received amount for the purchasing of the products, according to the provided means and terms.

6.9
The amounts will be refund as soon as possible and whithin fourteen (14) days from the date in which the Vendor received the request of return, we will provide for the activation of the refund procedures, once we have verified the correct execution of the indicated terms and conditions, as indicated on section 7.

6.10

If you do not respect the means and terms to exercise your return right, as in the letters a), e) and f) in 6.7, you will not have the refund of the amount you have already paid to the Vendor. Within 14 days from the receiving of the e-mail that communicates you the refusal of the acceptance of your return, you may choose to obtain again, at your own account, the products, in the same conditions of return, communicating this decision to the Vendor, according to the indicated means. On the contrary, the Vendor can hold the products, as well as the sums that you paid for purchasing them.

If you do not respect the conditions of the letters b), c) and d) in 6.7, you will not have the total refund of the amounts you paid to the Vendor. You will be responsible for a diminution of the value of the returned products, following a use that is different from the one authorized by the Vendor with the aim to allow you to verify the nature, the characteristics and the functioning of the products. If this is the case, we will deduct from the possible refund a percentage that goes from 10 to 90 percent of the amount you paid to the Vendor to purchase the returned products. You will receive an e-mail from the Vendor that will communicate this decision. Within 14 days from the sending of the e-mail that communicates you the deducted amount from the refund, you may decide to obtain again the products, at your own account, and in the same conditions you have sent them back to the Vendor, communicating the decision to the Vendor, using the means that will be indicated to you. On the contrary, the Vendor can hold the products and the percentage that has been deducted from the refund.

7.Tempi e modalità di rimborso
7.1
The Vendor will examine all products returned as damaged or defective and will notify you of your refund via e-mail within a reasonable period of time. We will usually process any refund due to you as soon as possible and, in any event, within fourteen (14) days of the day we confirm to you via e-mail that you are entitled to a refund for the damaged or defective product. Subject to acceptance by the Vendor of the damaged or defective goods, products returned by you because they are damaged or defective will be refunded in full, including the cost of delivery for sending the item to you and the cost incurred by you in returning the item to the Vendor. In the event that the Vendor finds no fault with the returned products, you will be notified that the returned products cannot be accepted and you may elect to have the products re-delivered to you. If you do not accept re-delivery the Vendor reserves the right to retain the products and the purchase price and recover the Vendor’s fees and expenses from you.


7.2
We will usually refund any money received from you using the same method originally used by you to pay for the purchase, unless you have expressly agreed otherwise. If the recipient of the products indicated in the order form is different from the individual who made the payment for such products, the Vendor shall refund the amount paid for returned items to the individual who made the payment.


7.3
The value date for the credit shall be the same as the value date of the original debit and consequently you shall not suffer interest losses.


7.4
The Vendor indicates Sda (www.sda.it) as the courier for the return of the products. Through Sda, using the identification tag attached to the pack that contained the products, you can return the products to the Vendor, without paying the shipping costs at your own account. According to the provided means and terms for the return right, in this way the Vendor can provide for the shipping costs of the purchased products at your account, freeing you from any obligation towards the courier. This method gives the possibility to verify, in anhy moment, where the pack is, freeing you from any responsability in case of loss or damage of the products furing the shipping.

7.5
If you decide to use a different courier from the one indicated by the Vendor on the online Return Form, you would have to pay at your own account the shipping costs for the return of the purchased products. In this case, you will have the refund of an amount that corresponds to the standard costs of shipping of the purchased products, but there will be no refund for any extra cost you had by choosing a different type of shipping or faster than the standard one. The responsibility for any loss or damage of the products during the shipping may be on you, in case it is due to your neglecting choice of the courier and/or of the shipping mean.

9. Governing Law

9.1
These General Terms and Conditions of Sale are governed by Italian law and in particular by Italian legislative decree no. 206 of 6 September 2005 on distance contracts and by Italian legislative decree no. 70 of 9 April 2003 on certain aspects related to e-commerce.


9.2

Any dispute arising between Ornamentum of Claudia Lotierzo and any of its final users shall be subject to the conciliation service RisolviOnline. RisolviOnline is an independent and institutional service, provided by the Arbitral Chamber of the Chamber of Commerce of Milan, which allows the achievement of a satisfying agreement, through the help of a neutral and competent judge, in a friendly and safe way, on Internet. 10. Amendments and updates
The General Terms and Conditions of Sale may be amended from time to time due to new laws and regulations or other reasons. The new General Terms and Conditions of Sale shall be effective as of the date of publication on www.ornamentum.it.
